Privacy Policy

Effective date: 11 August 2026

This Privacy Policy explains how The Genius Institute (Giorgio Genaus), based in Sydney, NSW, Australia ("we", "us", "our"), collects, uses, discloses and protects information when you use the Momentum Lab app and the associated Momentum Lab platform (together, the "App"), our private coaching community for founders and high performers.

By downloading, accessing or using the App, you agree to this Privacy Policy. If you don't agree, please don't use the App.

We may update this Privacy Policy from time to time. Continued use of the App after changes take effect means you accept the update.

1. Information We Collect

Directly from you: name, email address, phone number, profile photo, login credentials, any content you post in community discussions or direct messages, responses to coaching exercises or journaling prompts you choose to submit, and any information you provide when contacting us for support.

Automatically: device information (device type, operating system, unique device identifiers), IP address, app usage data (screens viewed, session recordings played, features used), crash and diagnostic logs, and push notification tokens.

From third parties: if you join or renew your Momentum Lab membership through a payment processor, we receive confirmation of payment and subscription status, not full card details. If you sign in using a third-party service, we receive the information that service shares with us under your permissions.

We do not knowingly collect sensitive health or medical information through the App. If you choose to share personal reflections related to your mental health or wellbeing in coaching sessions or community posts, that is your choice, and we treat it with the same confidentiality as other information described here.

2. How We Use Information

To provide the App: authenticate your account, and give you access to session recordings, community discussions, direct messaging and calendar bookings for live calls.

To run The Momentum Lab: administer your membership, process renewals and cancellations, and communicate with you about the program.

To support you: respond to questions, troubleshoot issues and provide customer service.

To improve the App: understand how members use the App so we can fix problems and build better features.

To keep the App secure: detect and prevent fraud, abuse and unauthorised access.

To send notifications: reminders about live calls, new content, and community updates, where you've enabled notifications.

We do not use your personal information to train generalised AI or machine learning models.

3. Community and Messaging Features

The Momentum Lab includes a private community feed and direct messaging. Anything you post is visible to other members of the community, or the recipient of a direct message. We ask all members to treat what's shared inside the group as confidential, but we can't guarantee that other members will honour that, and we aren't responsible for what other members do with information you share. Live call recordings may capture your voice, video and any content you share during the call, and are made available to Momentum Lab members for later viewing.

4. Legal Basis for Processing (EEA / UK Members)

Where you are in the European Economic Area, the UK, or Switzerland, we process your personal information based on: performing our contract with you (running your membership), your consent (for example, for optional communications), our legitimate interests (running and improving the App), or a legal obligation.

5. How We Share Information

We do not sell your personal information. We share information only with:

- Service providers who help us run the App and the Momentum Lab platform, including our hosting, app and community platform provider, email and messaging providers, and payment processor. These providers may only use your information to provide services to us.

- Professional advisers, where necessary for our legal, accounting or business purposes.

- Authorities, where required by law, to respond to legal process, or to protect the rights, property or safety of us, our members, or others.

- A buyer or successor, if The Genius Institute is involved in a merger, acquisition or sale of assets, subject to the buyer honouring the commitments in this Privacy Policy.

- Other parties, with your consent.

6. Data Retention

We keep your personal information for as long as you're a Momentum Lab member and for a reasonable period afterward, to comply with legal, accounting and record-keeping obligations, resolve disputes and enforce our agreements. You can ask us to delete your information earlier — see Section 8.

7. How We Protect Your Information

We use reasonable administrative, technical and organisational measures to protect your information, and require our service providers to do the same. No system is 100% secure. If you believe your account has been compromised, contact us immediately at the email below.

8. Your Rights

Depending on where you live, you may have the right to access, correct, delete, or request a copy of the personal information we hold about you, to object to or restrict certain processing, or to withdraw consent. To exercise any of these rights, contact us at the email below. We'll respond within a reasonable time and may need to verify your identity first.

Australian members: we handle your personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth). If you're unhappy with how we've handled a privacy complaint, you can contact the Office of the Australian Information Commissioner (oaic.gov.au).

California, Colorado, Connecticut, Utah and Virginia residents: you have rights under applicable US state privacy laws, including the right to know, access, delete and correct your personal information, and to opt out of certain uses. We do not sell personal information. To exercise these rights, contact us at the email below.

9. Children

The App is not intended for anyone under 18. We don't knowingly collect personal information from children. If you believe a child has provided us with personal information, contact us and we'll delete it.

10. International Transfers

We're based in Australia and use service providers located in other countries, including the United States. By using the App, you understand your information may be processed outside your home country, including in countries with different data protection laws.

11. Third-Party Links and Services

The App may link to third-party websites or services, for example payment processors or scheduling tools. We're not responsible for their privacy practices. Review their policies before providing your information.

12. Cookies (Web Version)

If you access the Momentum Lab platform through a web browser, we may use cookies and similar technologies to keep you logged in and understand how the platform is used. You can control cookies through your browser settings.

13. Changes to This Policy

We may update this Privacy Policy from time to time. We'll update the effective date above when we do. Material changes will be communicated to members directly.
